New forms of work and platform work: Chile case study

In Chile, unlike in many other countries, the rights of platform workers have been incorporated into labour law, with the adoption of Law no. 21.431 of 8 March 2022, which amends the Labour Code.1 Although the rights of platform workers are currently regulated by the Labour Code, this does not entail reclassification of all platform workers as employees. In fact, the Chilean Labour Code includes provisions for both dependent and independent platform workers, each with their own sets of rights, without prescribing a certain status.

In this document we outline the main provisions of the Labour Code that relate to the rights of platform workers.
